and conditions of use

H24Résa is an online platform that facilitates the rental of real estate between owners and tenants. These general terms and conditions of use 'Terms' govern your access to and use of the H24Resa platform, including all applications, services, features, technologies and software that we make available to you.

1. Age restrictions

To access and use the H24Résa Platform, you must be over 18 years of age and have the legal capacity to contract. By accessing the Platform, you represent and warrant that you meet these eligibility criteria.

2. H24Resa account

In order to use the H24Résa services, you must open an 'account' provided by H24Résa, and you must accept the H24Résa Terms of Use. You can create an Account using a telephone number, a Gmail account or a Facebook account.

3. Content Management

The H24Résa platform allows you to publish, store, share, send and receive information. By publishing content on H24Résa, you grant H24Résa a non-exclusive, worldwide, royalty-free, irrevocable, sublicensable and transferable license to access, use, store, copy, modify, publish, transmit, broadcast and otherwise exploit such content.

4. Rules and conduct

As a user of H24Resa, you agree to comply with all applicable laws and to not:

Use the Platform for illegal or unauthorized purposes ;
Publish or share content that is harmful, abusive, illegal, defamatory, obscene, or otherwise objectionable ;
Harass, threaten, or intimidate other users ;
Violate or infringe the rights of others, including intellectual property rights.

5. Limitation of liability and indemnification

H24Resa does not own, create, sell, resell, control, manage, offer, deliver, or provide real estate listings, rentals, or services. Owners are solely responsible for their real estate listings and services. .
You hereby indemnify H24Résa and agree to hold H24Résa harmless from and against any and all losses, claims, damages, costs and liabilities (including reasonable legal and accounting fees) arising out of your access to and misuse of the Platform.

6. Dispute resolution

You agree that all disputes between you and H24Résa will be settled by individual arbitration. You waive your right to a jury trial and to participate in any class action or class arbitration.

7. Applicable law

These conditions shall be interpreted and governed in accordance with the laws of the State of Côte d'Ivoire, including the texts of the OHADA and you submit to the exclusive jurisdiction of the court whose exclusive competence is attributed.
